In Ontario the limitation periods are defined under the Limitations Act, 2002, and by common law. In most cases claims may not be filed more than two years after the day on which the claim was discovered.
The fundamental question should be answered in deciding whether to sue is "Do I have a case?" You have a case if:
- The defendant owed a legal duty to you under the circumstances;
- The defendant breached that legal duty by acting or failing to act in a certain way;
- It was the defendant's actions (or inaction) that actually caused the damages; and
- You were harmed or injured as a result of the defendant's actions.
